PLS Litigation Update (1/25/24)

As you may know, in May 2020, The PLS.com (PLS), now known as the National Listing Service (NLS), brought a lawsuit in federal district court in California against NAR and three other defendants — California Regional MLS (CRMLS), Bright MLS and Midwest Real Estate Data (MRED) — in connection with the Clear Cooperation Policy (CCP). NAR prevailed in getting the case dismissed in February 2021. In April 2022, the Ninth Circuit Court of Appeals reversed the dismissal.

NAR and PLS have reached an agreement that will end this litigation. PLS has agreed to dismiss its claims without prejudice, and NAR has agreed to extend the statute of limitations for PLS’s claims through the end of 2024. NAR is not paying anything to PLS or committing to making any changes to our rules.

If PLS chooses to reengage in litigation, we are prepared to address their claims. In the meantime, and as always, we are glad to engage in thoughtful discussion about the future of our industry.
